These Terms of Service ("Terms") govern your use of the Mapela website and any related services (collectively, the "Service"). By accessing or using the Service, you agree to be bound by these Terms. If you do not agree, please do not use the Service.
1. What Mapela Is
Mapela is a free consumer tool that helps people discover happy hours, meal deals, kids-eat-free specials, and similar promotions at restaurants. We aggregate publicly available information from restaurant websites, public business directories, and third-party APIs, and present it on a map-based interface. We are not affiliated with and do not endorse any of the restaurants listed.
2. Deal Accuracy — Important Disclaimer
Deal information on Mapela is collected automatically from public sources and may be incomplete, outdated, or incorrect. Restaurants change their specials, hours, and pricing frequently, and not all changes are reflected here right away. We do not guarantee the accuracy, completeness, timeliness, or availability of any deal, price, time window, menu item, or restaurant detail shown on the Service.
Always confirm directly with the restaurant before traveling, ordering, or relying on any specific deal. Mapela is not responsible for losses, costs, or inconvenience that result from inaccurate, missing, or delayed information.
3. Intellectual Property
The Mapela name, logo, site design, code, and original content are owned by Mapela and protected by copyright, trademark, and other laws. You may not copy, reproduce, scrape, redistribute, or create derivative works of the Service or its original content without our written permission.
Descriptions, photos, menus, prices, business names, and similar content originate with the individual restaurants and other third-party sources. Those items remain the property of their respective owners and are displayed here for informational purposes only.
4. Removal Requests & DMCA
If you are a restaurant owner, operator, or rights holder and you want content about your establishment removed, updated, or corrected, please contact us through our Contact page. Include the restaurant name, location, a link to the listing if possible, and the reason for the request. We respond to reasonable takedown and correction requests promptly.
For formal copyright infringement notices under the Digital Millennium Copyright Act (DMCA), please submit a written notice that includes: (a) identification of the copyrighted work, (b) identification of the material you want removed and its URL on our site, (c) your contact information, (d) a statement of good-faith belief that the use is not authorized, (e) a statement under penalty of perjury that the information is accurate and that you are authorized to act on the rights holder's behalf, and (f) your physical or electronic signature. 5. Acceptable Use
You agree not to:
- Scrape, harvest, or automatically collect data from the Service without our permission.
- Interfere with the Service or attempt to access it through means other than the interfaces we provide.
- Use the Service in a way that violates any applicable law or third-party right.
- Impersonate any person or misrepresent your affiliation with any person or entity when contacting us.
6. Third-Party Services & Links
The Service links to and embeds content from third parties, including Google Maps / Google Places, OpenStreetMap, Leaflet, and individual restaurant websites. We do not control those third parties and are not responsible for their content, availability, or practices. Your use of any linked site or embedded service is governed by the terms and privacy policies of that third party.
7. No Warranty
The Service is provided "AS IS" and "AS AVAILABLE" without warranties of any kind, express or implied, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy. We do not warrant that the Service will be uninterrupted, error-free, or free of harmful components.
8. Limitation of Liability
To the maximum extent permitted by law, Mapela and its operators, contributors, and affiliates will not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits, revenue, data, or goodwill, arising out of or related to your use of (or inability to use) the Service — including any reliance on deal, price, time, menu, or other information displayed. Our total liability for any claim relating to the Service is limited to one hundred U.S. dollars ($100).
9. Indemnification
You agree to defend, indemnify, and hold harmless Mapela and its operators from any claims, liabilities, damages, losses, and expenses (including reasonable attorneys' fees) arising out of your use of the Service or your violation of these Terms.
10. Changes to the Service or Terms
We may modify, suspend, or discontinue the Service at any time without notice. We may also update these Terms from time to time; when we do, we will update the "Last updated" date at the top of this page. Continued use of the Service after a change means you accept the revised Terms.
11. Governing Law
These Terms are governed by the laws of the State of Colorado, without regard to its conflict-of-law rules. Any dispute arising out of or relating to the Service or these Terms will be resolved in the state or federal courts located in Denver County, Colorado, and you consent to personal jurisdiction there.
